Terms of Service
Welcome to Vexio CreatorHub. These Terms of Service ("Terms") form a legally binding agreement between you and The Way Ltd ("Vexio", "CreatorHub", "we", "us", "our"). By creating an account, accessing, or using the Vexio CreatorHub mobile application or related services (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Vexio CreatorHub is a marketplace and messaging platform that helps content creators on TikTok, Instagram, YouTube, X, Facebook, Snapchat, and similar platforms connect with small businesses seeking promotional services. The Service allows users to create profiles, list services they offer, browse other users, exchange messages, and follow each other. The Service is not a payment processor, escrow agent, employment agency, advertising agency, or talent management company.
2. Eligibility
To use Vexio CreatorHub you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding contract in your country of residence
- Not be barred from using the Service under applicable law
- Not have previously been banned from the Service
By creating an account you confirm that you meet these requirements.
3. Your account
You are responsible for everything that happens under your account. You must:
- Provide accurate, current, and complete information when you sign up
- Keep your sign-in credentials confidential (we use Apple Sign-In and Google Sign-In; we never store passwords)
- Notify us immediately if you suspect unauthorised access
- Use the Service only for lawful purposes
We may suspend or terminate your account at any time if you violate these Terms, harm other users, or create risk for the Service. You can delete your account at any time from Settings → Account → Delete Account.
4. User content
"User Content" means anything you post, upload, send, or display through the Service — including profile information, photos, listings, messages, and reports.
Ownership. You keep ownership of your User Content.
Licence to us. By posting User Content you grant The Way Ltd a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that content for the purpose of operating, improving, and promoting the Service. This licence ends when you delete the content or your account, except where retention is required by law.
Your responsibility. You are solely responsible for your User Content. You confirm that you own or have all necessary rights to post it, and that it does not infringe anyone else's rights or violate any law.
5. Acceptable use
You must not use the Service to:
- Post content that is unlawful, fraudulent, deceptive, defamatory, obscene, hateful, harassing, threatening, or that promotes violence
- Post sexual content, nudity, or content involving minors
- Impersonate any person or misrepresent your identity
- Harass, bully, stalk, or threaten other users
- Solicit personal financial details (bank accounts, card numbers, ID copies) from other users
- Spam, scrape, or send unsolicited promotional messages
- Sell illegal goods or services, counterfeit items, regulated products without authorisation, or services that violate the policies of TikTok, Instagram, YouTube, X, Facebook, Snapchat, or any other third-party platform
- Promote scams, MLM/pyramid schemes, cryptocurrency speculation, gambling, or financial advice
- Use bots, automated scripts, or scraping tools against the Service
- Reverse-engineer, decompile, or attempt to extract source code
- Circumvent any safety, moderation, or access-control feature
We may remove content or terminate accounts that violate these rules without notice.
6. Transactions between users
Vexio CreatorHub is a discovery and messaging platform. We do not process payments, hold funds in escrow, verify deliverables, or act as a party to any transaction between users. Any agreement, payment, or exchange of services between users happens directly between them and is their own responsibility.
You acknowledge and agree that:
- You are responsible for evaluating the other party before doing business with them
- You are responsible for your own taxes, invoices, and contracts
- Vexio is not liable for the quality, legality, safety, or delivery of any service or product offered through the Service
- Vexio is not liable for any losses, damages, or disputes arising from transactions between users
- Disputes between users must be resolved directly between the users; we are not obligated to mediate
- You should use a reputable payment provider (e.g. PayPal, Stripe) that offers buyer or seller protection, and never share bank details or send money via unsafe methods
If you believe another user has scammed, defrauded, or harmed you, you may report them inside the app or by emailing us. We may ban repeat offenders but we cannot guarantee recovery of any funds or content.
7. Subscriptions and payments to Vexio
Vexio CreatorHub offers an optional premium subscription ("Vexio Pro" or "CreatorHub Pro") through Apple In-App Purchase, managed by RevenueCat. Subscription pricing, features, and renewal terms are shown inside the app at the point of purchase.
- Subscriptions renew automatically until cancelled
- Cancel any time in your Apple ID subscription settings — cancellation takes effect at the end of the current billing period
- Refunds for App Store purchases are handled by Apple under their refund policy, not by us
- We may change subscription features or prices with reasonable notice
We never receive or store your payment card details. All payment processing is performed by Apple.
8. Intellectual property
The Service, including the Vexio name, logo, design, code, and all related materials, is owned by The Way Ltd and protected by intellectual property law. You may not copy, modify, distribute, sell, lease, or create derivative works of any part of the Service without our written permission. Feedback you send us is welcome and may be used by us without obligation or compensation to you.
9. Third-party services
The Service integrates with third-party services including Apple, Google (Firebase), and RevenueCat. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the practices of third parties. The Service may also display links to third-party websites or platforms. Following those links is at your own risk.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately if you violate these Terms, create legal risk for us or other users, or if we are required to do so by law.
On termination:
- Your right to use the Service ends immediately
- We may delete or retain your User Content in accordance with our Privacy Policy
- Sections of these Terms that by their nature should survive (ownership, disclaimers, liability, indemnity, governing law) will continue to apply
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted operation.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
- Any user is who they claim to be
- Any service offered by another user will be delivered as described
You use the Service at your own risk. Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example, liability for death or personal injury caused by negligence, or fraudulent misrepresentation).
12. Limitation of liability
To the maximum extent permitted by law, The Way Ltd, its directors, employees, and agents will not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, goodwill, or business opportunity
- Any damages arising from disputes between users
- Any damages arising from third-party services
- Any damages arising from unauthorised access to your account caused by your failure to protect your credentials
Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the total amount you have paid to Vexio in the 12 months before the claim, or (b) £100.
13. Indemnity
You agree to indemnify and hold harmless The Way Ltd, its directors, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of:
- Your User Content
- Your use of the Service
- Your violation of these Terms
- Your violation of any law or any third party's rights
- Any transaction or dispute between you and another user
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you inside the app or by email at least 14 days before the changes take effect. Continued use of the Service after the changes become effective constitutes acceptance of the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, except where you have non-waivable rights under the law of your country of residence. If you are a consumer in the UK or EU, nothing in these Terms affects your statutory consumer rights.
16. General
- Entire agreement. These Terms, together with the Privacy Policy, form the entire agreement between you and us regarding the Service.
- Severability. If any part of these Terms is held unenforceable, the rest will remain in effect.
- No waiver. Our failure to enforce any right under these Terms is not a waiver of that right.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor business.
- Notices. We may give you notices inside the app or by email to the address on your account.
